THE INFORMATION WE GATHER

We gather two types of information about users of FoFoFiggily.com:

(2) Personally identifiable information: To participate in FoFoFiggily.com beyond visiting the website itself (such as to access Fo Fo’s virtual world), we require that you provide us with certain personally identifiable information (such as your name, e-mail address and birth date). Additionally, F3 or third parties (such as our FoFoFiggily.com advertisers and e-commerce partners) may provide F3 with personally identifiable information about you, which was not collected on the FoFoFiggily.com site, and we may add such data to your membership information. FoFoFiggily.com may also combine information you submit in connection with certain features of the FoFoFiggily.com site (such as newsletters, polls or contests) with membership information you provided.

HOW WE USE (AND DO NOT USE) THE INFORMATION WE GATHER

Even though such information might not identify you personally, we strongly encourage you to become familiar with the privacy practices of those sites.

(2) Personally identifiable information: F3 uses personally identifiable information as set forth herein.

1. No Intentional Sale or Lease: Except as set forth within this Privacy Policy and our Terms of Service and other published guidelines, F3 does not intentionally sell or lease personally identifiable information collected from FoFoFiggily.com members and visitors to unaffiliated third-party marketers without the permission ofsuch members and visitors.
2. Opt-In/Opt-Out Policy: When you become aFoFoFiggily.com member or otherwise supply F3 with personally identifiableinformation in connection with the FoFoFiggily.com site, or fromtime-to-time in F3?s discretion, you may be asked to indicate whether youare interested in receiving information from us about special offers in connection with the FoFoFiggily.com site, F3 and/or our advertisers and partners. You will also be provided with the opportunity to opt-in toreceiving offers directly from our third-party advertisers or partners. Ifyou do choose to opt-in, you will receive such communications inaccordance with your “opt-in” consent. If you decide to contact us to change your contact preference to “Do Not Contact Me”, F3 will implement this change to your FoFoFiggily.com profile within ten (10) business days of your request. Please be aware that your requested change will not be effective until F3 implements such change and that such requests will be implemented only in connection with your FoFoFiggily.com profile, and will not impact any preferences you may have made to any other site controlled, owned or operated by F3 or its affiliates. In addition, please keep in mind that even if you opt-out from receiving communications from FoFoFiggily.com, residual information about you will remain within F3 databases, access logs and other records, which may or may not contain such personally identifiable information. The residual information will not be used for commercial purposes; however, F3 reserves the right, from time to time, to recontact former customers or users of FoFoFiggily.com for administrative purposes, as discussed below under “Administrative Matters”, or in order to comply with applicable law, as discussed below under “Compliance With Applicable Law”.

Administrative Matters: F3 reserves the right to contactyou in the event of a change in the FoFoFiggily.com Terms ofService and/or this Privacy Policy, or to notify you of other administrative matters in connection with the FoFoFiggily.com site and/orthe F3 network (e.g. contacting you to facilitate, complete or confirm atransaction).
2. Targeted Advertising: F3sometimes uses individual data collected via FoFoFiggily.com to “target”advertising – to decide which advertisements and sponsor messages to showto which members. As an example, if Sponsor Co. wishes to display itsadvertising only to FoFoFiggily.com members aged 16, F3 uses member registration data to ensure that Sponsor Co.’s ads are displayed only to such members.
3. Transactions With E-CommercePartners, Vendors and Advertisers: When you provide personallyidentifiable financial information and other personally identifiableinformation to one of our FoFoFiggily.com e-commerce partners, vendors oradvertisers, this transaction will occur in connection with the site ofthe e-commerce partner, vendor or advertiser, not on the FoFoFiggily.com site, and, as such, the financial and other personally identifiable information you provide is collected pursuant to and controlled by theprivacy policy of such e-commerce partner, vendor or advertiser. 5. F3 Employees, Contractors andAgents: F3 may employ other companies and individuals to perform functionson our behalf, such as processing of payments, operating features of the FoFoFiggily.com site, or hosting or maintaining our servers. These other companies may have access to your personal information as necessary tocarry out their functions, but they are not permitted to share thatinformation with any third party absent your consent.
6. Contests, Promotions orSweepstakes: If and when F3 sponsors contests, promotions or sweepstakes,or third parties sponsor contests, promotions or sweepstakes inconjunction with the FoFoFiggily.com site, either F3 or the third partywill post relevant privacy information in the official rules and/or registration area for the contest, promotion or sweepstakes. 7. Surveys and Polls: Oursurveys and polls ask for your opinions on various issues, and very oftenthese surveys and polls are sponsored by or associated with F3 advertisersand partners. Occasionally, we may request demographic information (likezip code, age or gender). Most information obtained through surveys and pollsis aggregated and used internally or shared with advertisers and partnersonly in the aggregated form. In the event F3 seeks your opinion in asurvey or poll conducted by F3 without any association with or sponsorshipby a third party, and we request personally identifiable information aboutyou as part of such survey or poll, the use of your personallyidentifiable information will be governed by this Privacy Policy. In theevent a poll or survey is sponsored by or associated with a F3 advertiseror partner, such advertiser or partner may seek to collect and use your information. Please review each poll and survey carefully before submitting your information to determine whether you are submitting your information to F3 or to a F3 partner or advertiser. In the event that youare submitting your information to a F3 partner or advertiser, the use ofyour information will not be governed by this Privacy Policy. In anyevent, F3 reserves the right to add your survey answers to your memberportrait (so that we can provide you with content, ads and offers that wefeel will be of greatest interest to you).
8. “Email This to a Friend”: TheFoFoFiggily.com site allows you to forward certain items posted onFoFoFiggily.com or links to other FoFoFiggily.com features by email orInstant Messenger to other parties who you believe may be interested.While, due to technical restrictions, the recipient’s email address orInstant Messenger screen names may be retained in our log files, we do not knowingly share it with third parties (unless the recipient has already consented to such use of her personally identifiable information).
9. Compliance with ApplicableLaw. F3 may also access and disclose personally identifiable informationin the event that we believe, in F3?s discretion, that such action isreasonably necessary to comply with government requests; to enforce the Termsof Service or other published guidelines; to protect F3, its users orothers; to respond to circumstances that we feel constitute an emergency;or as otherwise required or permitted by applicable law. Please be aware that, in connection with the foregoing, F3 may provide information aboutyou gathered through other sites controlled, owned or operated by F3 or F3affiliates to the extent permitted under the applicable privacy policygoverning collection and use of such information.
10. Business Transfers. We maysell or transfer assets or portions of our business as we continue toimprove our product and service offerings. In such transactions, user orvisitor information (whether non-personally identifiable or personallyidentifiable) may constitute one of the transferred business assets.

ADVERTISING COMPANIES

Advertising that appears in connection with the FoFoFiggily.com site and services is currently served by third-party advertising companies. These ads may contain cookies, pixel tags or other tracking technologies that collect information about our visitors to which we do not have access and the use of which is not governed by this Privacy Policy. These companies may use information about your visits to FoFoFiggily.com to assist with serving ads about goods and services of interest to you.

CHANGING PERSONAL INFORMATION

GUIDELINES REGARDING CHILDREN

We encourage parents to monitor and participate in their kids’ activities on the Internet.  Please visit our Letter to Parents for further information concerning FoFoFiggily.com. In compliance with the Children’s Online Privacy Protection Act (COPPA), any visitor under the age of 13 who wishes to register with the site and provide any personal information must first have their parent or guardian send written consent for their participation. FoFoFiggily.com will not collect or use any personal information of any user or visitor under the age of 13 without first obtaining the consent of that person’s parent or guardian.

HOW WE PROTECT AND SECURE YOUR INFORMATION

OFFLINE VS. ONLINE PRACTICES
